Effective January 1, 2009, all residential and commercial construction subcontractors who operate as individual proprietors will be considered employees of the general contractor with whom they have contracted, unless they have a valid Independent Contractor Exemption Certificate (CEC). Individuals must apply and submit documents to show they can meet the requirements of a nine-factor test to acquire the ICEC.
Because the law affects the employment status of independent contractors, the ramifications of not complying are far reaching. FICA, unemployment insurance, federal and state withholding requirements as well as workers’ compensation coverage could be impacted.
